| dc.description | Access to culture is a fundamental right of second generation, under Article 215 of Brazilian Federal Constitution. Its inclusion in the second generation of positive rights implies the need to active stance by the state for its implementation and universalization. Whenever something come in contrariety to the value system of nationality, ways of art engaged emerge to prevent their extinction. Every citizen needs to know, consume and believe in his own culture, receiving an education of quality, that fully respect his cultural identity. Brazilian cultural policy, through tax incentive laws, is trying to remedy the serious obstacles encountered in popular access to culture, without achieving the necessary success to give each one what is rightfully yours. This article aims to examine the foundations of our laws to encourage the culture in order to understand why we still have a large population away from artistic production. | en-US |
| dc.description | O acesso à cultura constitui um direito fundamental de segunda geração, previsto no artigo 215 de nossa Constituição Federal. Sua inclusão na segunda geração dos direitos positivos implica em afirmar a necessidade de posicionamento ativo por parte do Estado para sua efetivação e universalização. Sempre que algo se antepõe ao sistema de valores da nacionalidade, surgem formas de arte engajadas para evitar seu perecimento. Todo cidadão precisa conhecer, consumir e acreditar em sua cultura, recebendo uma educação de qualidade, que respeite plenamente sua identidade cultural. A política cultural brasileira, mediante leis de incentivo fiscal, vem tentando sanar os graves óbices encontrados no acesso popular à cultura, sem alcançar êxito para conceder a cada um o que lhe é direito. O presente artigo visa examinar as bases de nossa legislação de incentivo à cultura, buscando entender a razão da maior parte da população encontrar-se afastada das manifestações artísticas produzidas. | pt-BR |
