Descripción :	In this paper, the debate about the fiscal propositions of Alexander Hamilton in 1787 is recalled to analyze the genesis of the bipartisan system in the United States. In the context of Stuart Mill’s question of to what extent forms of government are a matter of choice, it is argued that the political division generated around the dilemma of what the Treasury Department’s attributions should be evolved into structuring a two-party system, showing how the unexpected contingencies and the operationalization of existing laws can mean a mismatch with constitutional provisions. Initially, the policies presented by Hamilton to the First Congress are revisited, regarding its financial program for the public debt and the creation of a National Bank as well, and seek to synthesize the motivations of this legislator in such process. The discussion is further developed by adding domestic and international themes that aggravated the conflict between the groups involved in the US government, leading to the creation of an opposition to the federalists and to what would ultimately be against the norms established by the Constitution and by the conjuncture of the time: the formation of two parties. Neste artigo retoma-se o debate em torno das proposições fiscais de Alexander Hamilton em 1787 para analisar a gênese do sistema bipartidário nos Estados Unidos. Tendo como pano de fundo o questionamento de Stuart Mill acerca de até que ponto as formas de governo são uma questão de escolha, argumentase que a divisão política gerada em torno do dilema sobre quais deveriam ser as atribuições do Departamento do Tesouro evoluiu até a estruturação de um sistema bipartidarista, evidenciando como as contingências inesperadas e a operacionalização das leis existentes podem significar um descompasso com disposições constitucionais. Inicialmente, revisita-se as policies apresentadas por Hamilton ao Primeiro Congresso, tanto em relação ao seu programa financeiro para a situação da dívida pública quanto à criação de um Banco Nacional, e procura-se sintetizar as motivações desse legislador em tal processo. Posteriormente, aprofunda-se a discussão acrescentando questões de ordem doméstica e internacional que agravaram o conflito entre os grupos envolvidos no governo estadunidense e suscitaram a formação da oposição aos federalistas e também ao que se constituiria, por fim, na contramão dos pressupostos estabelecidos pela Constituição e pela conjuntura da época: a formação de dois partidos.
