| dc.description | The Constitutional Justice is undoubtedly a key figure in the Nicaraguan legal system. Thesearch for its origin constitutes an opportunity to learn about the advances in a subject thatis in constant development, which guarantees a true balance of powers; For this reason, thisarticle focuses on locating the general aspects from its origin, as well as the essential elementsthat have been part of its evolution and that integrate it, addressing the Constitutionalframework of the Nicaraguan control system as the guarantee Constitution that protects thesupremacy of the Magna Carta. It is the Constitution itself as a superior hierarchical normthat indicates the way to control the acts of public power, which are carried out throughdiffuse or concentrated control and that in the case of Nicaragua is a combination of both.The innovative contributions of the current Law 983, “Constitutional Justice Law”, whichprotects the rights and guarantees of Nicaraguans, both individual rights, as well as socialand political rights contained in the Constitution. This research article contains an analysisof the problems that were generated in Nicaragua by not having a single normative body ofthe instruments of jurisdictional protection of the Constitution and the need for them to begrouped together. The dialectic method and documentary research are used, for this purposethe Political Constitution and national legislation were studied, as well as internationallegislation and doctrine, all in relation to Constitutional Justice. | en-US |
| dc.description | La Justicia Constitucional es indudablemente una figura clave del sistema legal nicaragüense. La búsqueda de su origen constituye una oportunidad para conocer los avances en una materia que está en constante desarrollo, misma que garantiza un verdadero equilibrio de los poderes; por este motivo, el presente artículo se enfoca en ubicar los aspectos generales desde el origen de la misma, así como los elementos esenciales que han formado parte de su evolución y que la integran, abordando el marco Constitucional del sistema nicaragüense de control como la garantía constitucional que protege la supremacía de la Carta Magna. Es la misma Constitución como norma jerárquica superior la que indica el camino para el control de los actos del poder público, que se llevan a cabo mediante el control difuso o concentrado y que en el caso de Nicaragua es una combinación entre ambos. Los aportes innovadores de la actual Ley 983, “Ley de Justicia Constitucional”, que protege los derechos y garantías de los nicaragüenses, tanto los derechos individuales, así como los derechos sociales y políticos contenidas en la Constitución Política. El presente artículo de investigación contiene un análisis sobre la problemática que se generaba en Nicaragua por no tener un solo cuerpo normativo de los instrumentos de protección jurisdiccional de la Constitución y la necesidad de que los mismos se agruparan. Se utiliza el método dialectico y de investigación documental, a este efecto se estudió la Constitución Política y la legislación nacional, así como la legislación y doctrina internacional, todo ello en lo relativo a la Justicia Constitucional. | es-ES |
