Descripción :	The author, based on national legislation and the International Law of Human Rights, exposes a critic to the recent judgment STC 1522-2016- PHC/TC of the Constitutional Court of Peru. Considering that it violates the right to effective judicial protection due to it´s established that “in response to new circumstances” of a case, a judgment with the quality of res judicata could be annulled even when in the same case previously had been protected the fundamental right of the defendant. El autor, basado en la legislación nacional y en el Derecho Internacional de los Derechos Humanos, expone una crítica a la reciente STC Exp. N.º 1522-2016-PHC/TC, que considera violatoria del derecho a la tutela judicial efectiva al haber establecido que “atendiendo a las nuevas circunstancias” de un caso podría dejarse sin efecto una sentencia que tiene calidad de cosa juzgada en ese mismo caso, en el que con anterioridad se había amparado el derecho fundamental del justiciable.
