This paper aims to answer if Congress has the faculty to amend the Especial Jurisdiction for Peace (JEP). For that the paper presents a review of the amendment process by which the JEP was included to the Constitution. Later, it presents the legal elements of the discussion, analyzing the juridical shield of the Peace Agreement and legal nature of the JEP as constitutional origin institution. Finally, the paper presents a thesis about the implicit limitations of the constitutional amendment power of Congress in political transitions.
Este articulo busca responder sí el Congreso tiene la competencia para reformar la Jurisdicción Especial para la Paz (JEP). Para esto presenta una revisión jurisprudencial de los principales aspectos del procedimiento de inclusión de la JEP a la Constitución. Después, presenta los elementos jurídicos de la discusión, analizando puntos como el blindaje jurídico del Acuerdo de Paz y la naturaleza jurídica de la JEP como un órgano de origen constitucional. Finalmente, este articulo presenta una tesis sobre los límites implícitos al poder de reforma de la Constitución del Congreso en transiciones políticas.
