Universal periodic review as a migration desecuritization instrument: the case of Spain

Descripción : For the last decades, it was observed that the migration subject was addressed as a security issue due to a social construction proposed by the state that sees immigrants as a threat to security, in which they are subconsciously considered as “the other”. Thus, migration issues started to be analyzed under the security bias, which resulted in the topic being securitized instead of politicized and discussed by all sectors of society and under the human rights scope. In 2006 the United Nations Human Rights Council created the Universal Periodic Review (UPR) mechanism, which allows all UN member states to have their human rights situations reviewed every four years and a half. In this respect, the paper aims at presenting how the UPR mechanism may be a tool to desecuritize the migration subject by using Spain as a study case, which is the country that receives more recommendations about migrants among all UN member states. Therefore, the research focuses on a comprehensive evaluation of documents on Spain outcomes in the first two UPR cycles, in order to identify the main recommendations about the migration subject and to understand the interventions related to Spain's position on accepting or not such recommendations. The purpose here is to check the effectiveness of the UPR as a tool that may contribute to the desecuritization of the migration subject under the human rights perspective. The research focuses on a review of documents and bibliographic references, with a qualitative approach and exploratory nature. The initial result points out that the interactive discussion promoted by the UPR mechanism can help support to desecuritize the migrant issue.
RESUMEN: Durante las últimas décadas, se observó que el tema de la migración se abordó como un problema de seguridad debido a una construcción social propuesta por el Estado de los inmigrantes como una amenaza para la seguridad, en la que se los considera inconscientemente como "el otro". Por lo tanto, los problemas de migración comenzaron a analizarse bajo el sesgo de seguridad, lo que resultó en que el tema se titulizara en lugar de ser politizado y discutido por todos los sectores de la sociedad y en el ámbito de los derechos humanos. El Consejo de Derechos Humanos de las Naciones Unidas creó, en 2006, un mecanismo de Revisión Periódica Universal (EPU) que permite que todos los estados miembros de la ONU revisen sus situaciones de derechos humanos cada cuatro años y medio. A este respecto, el documento tiene como objetivo presentar cómo el mecanismo del EPU puede ser una herramienta para desecuritizar el tema de la migración utilizando a España como un caso de estudio, que es el país que recibe más recomendaciones sobre migrantes entre todos los estados miembros de la ONU. Por lo tanto, la investigación se centra en una evaluación exhaustiva de documentos sobre los resultados de España en los primeros dos ciclos de EPU, con el fin de identificar las principales recomendaciones sobre el tema de la migración y comprender las intervenciones relacionadas con la posición de España sobre aceptar o no tales recomendaciones. Por esa razón, el propósito del documento es verificar la efectividad del EPU como una herramienta que puede contribuir a la desecuritización del tema de la migración desde la perspectiva de los derechos humanos. La investigación se centra en una revisión de documentos y referencias bibliográficas, con un enfoque cualitativo y de naturaleza exploratoria. El resultado inicial confirmó que la discusión interactiva promovida por el mecanismo del EPU promueve el apoyo para desecuritizar al sujeto migrante.
