Descripción :	ResumenEn Venezuela se refleja la tendencia mundial de incluir a los derechos humanos como un elemento indispensable para la consolidación del Estado de derecho. El presente trabajo tratar de establecer cómo la declaratoria de estados de excepción exacerba problemas existentes entre el Estado y los ciudadanos y entre el gobierno y los órganos ejecutores, incrementado la posibilidad de violaciones a los derechos humanos. Esta perspectiva permite identificar con mayor exactitud las características propias de los distintos problemas que se pueden presentar en la relación entre el Estado, los órganos ejecutores y supervisores, y los ciudadanos.El estado de excepción es el mecanismo (contemplado en el ordenamiento jurídico) que utiliza el Estado para hacerle frente a eventualidades que causan emergencia normativa ordinaria. Esto ocasiona que durante sdeclaratoria el Estado goce de una serie de “privilegios que normalmente no posee, ya que los mecanismos ordinarios de control se ven parcialmente  suspendidos. Todo esto permite que al Estado le sea más fácil desviarse de lo que sería su conducta proba, pudiendo obtener de esta forma beneficios particulares, incluso mediante la violación de los derechos humanos.AbstractIn Venezuela in reflected the world tendency of including to the human rights how an indispensable element for the consolidation of the State of Right. The present work to try to settle down as the declaration of exception states exacerbates existent problems between the State and the citizens and between the government and the organs executioners, increased the possibility of violations to the human rights. This perspective allows to identify with more accuracy the characteristics of the differet problems that con be presented in the relationship among the State, the organs executioners and supervisors and the citizens.The exception state is the mechanism (contemplated in the juridical classification) that it uses the State to make him in front of eventualities that cause emergency in everything or it leaves of the country, and that for its nature and graveness they can not be solved by the normative one ordinary. This causes that during their declaration, the State enjoys a series of “privileges” that doesn’t possess usually, since the ordinary mechanisms of control they are partially suspended. All this allows that to the State it is he easier to stray of what would be their behavior appropriate, being able to obtain in that way particular benefits, even by means of the violation of the human rights.
