| Descripción : | This article reconstitutes the circumstances, the ways, and the consequences of the encounter between its author and Carl Schmitt’s work, around 1980. It explains the reasons that led him to publish, after a
first work on Schmitt and Hegel, the 2011 book What Is to Be Done with
Carl Schmitt? Current thinking about Law and Politics can nurture from certain elements of reflection that were developed by Schmitt, for instance, in relation to the “political theology”, legitimacy, the “end of
the State”, or the unity of the world. But it is important to resist the fascination that can be exerted by that work, and to be fully aware of its limits and aporias, since Schmitt’s support to National Socialism was rather a consequence than a cause of them.
Este artículo repone las circunstancias, las formas y las consecuencias del encuentro entre su autor y la obra de Carl Schmitt, hacia 1980. En él se exponen los motivos que lo condujeron, tras un primer trabajo consagrado a Schmitt y Hegel, a publicar, en 2011, el libro titulado ¿Qué hacemos con Carl Schmitt? La reflexión actual sobre el derecho y la política puede nutrirse de ciertos elementos de reflexión desarrollados por Schmitt, por ejemplo, a propósito de la “teología política”, de la legitimidad, del “fin del Estado” o de la unidad del mundo. Pero hay que resistir, sin embargo, la fascinación que puede ejercer esta obra, y tomar conciencia de sus límites y de sus aporías, pues la adhesión de Schmitt al nacionalsocialismo es la consecuencia, más que la causa, de ellas. |
