| dc.description | Analizar las diferentes posturas que tienen los jueces frente a los múltiples casos que se presentan día a día en sus despachos, con referencia al delito de “Tráfico, fabricación o porte de estupefacientes”, el cual tiene una excepción a la regla que refiere la legalidad de la dosis personal, y la cual es permitida por el Estado Colombiano. De estas posturas queremos analizar y revisar fallos que han surgido en torno 98 a este delito, y resolver las dudas que así mismo se generan, por la ardua controversia que genera este tema. Pues es así como se han creado normas, actos legislativos y decretos que prohíben, sancionan y permiten el porte y consumo de estupefaciente. De igual manera en el presente trabajo se analizará el acto legislativo 002 del 2009, que prohíbe todo porte y consumo de estupefacientes, salvo prescripción médica, ante la modificación que hiciera la Ley 1453 del 24 de junio del 2011 y demás normas que han venido surgiendo. | - |
| dc.description | Analyze the different positions that judges have in the face of the multiple cases that are presented day by day in their offices, with reference to the crime of "Trafficking, manufacture or possession of narcotics", which has an exception to the rule referred to by law of the personal dose, and which is allowed by the Colombian State. From these positions we want to analyze and review failures that have arisen around 98 to this crime, and to resolve the doubts that are also generated, due to the arduous controversy that this issue generates. Well, this is how norms, legislative acts and decrees have been created that prohibit, sanction and allow the carrying and consumption of narcotic drugs. Similarly, in this paper, legislative act 002 of 2009 will be analyzed, which prohibits all carrying and consumption of narcotic drugs, except for medical prescription, before the modification made by Law 1453 of June 24, 2011 and other regulations that have been emerging . | - |
