dc.descriptionLa presente obra tubo sus inicios en el convenio celebrado entre el Tribunal Administrativo de Santander, presidido por la Honorable Magistrada Doctora Solange Blanco Villamizar y el Centro de Investigaciones de la Universidad Autónoma de Bucaramanga – Estudios Jurídicos – el cual esta en cabeza de su director el reconocido abogado y catedrático, maestro de la ciencia del derecho, Doctor Laureano Gómez, ambos aprovechando sus conocimientos y en aras de mejorar el modulo de la relatoria del Tribunal Administrativo de Santander, se dieron a la tarea de crear un proyecto de investigación el cual denominaron: “ANALISIS JURISPRUDENCIAL DE LAS PROVIDENCIAS EMANADAS POR EL TRIBUNAL ADMINISTRATIVO DE SANTANDER Y EXAMINADAS POR EL CONSEJO DE ESTADO, CON EL FIN DE MEJORAR LA RELATORIA DEL MISMO Y DEFINIR SU LINEAMIENTO JURISPRUENCIAL”, dicho proyecto tenia como fin crear línea jurisprudencial y prestar a través de la academia un apoyo que ayudara a consolidar la relatoría de la mencionada corporación. Es así como inicialmente, previa selección del material de estudio por la corporación, se procedió a realizar el análisis estructural de cada una de las sentencias entregadas, trabajando de esta manera en la identificación de la sentencia, selección de hechos relevantes, identificación del problema jurídico, fundamentos de la sala, las fuentes utilizadas y el método (refiriéndonos a las técnicas de la hermenéutica jurídica) empleado en cada caso; una ves obtenido el resultado que se pretendía, se procedió a la realización de un análisis critico de cada una de ellas, basado en criterios jurisprudenciales, legales y doctrinales; acto seguido se sintetizo el resultado anterior en un cuadro que muy amablemente nos proporciono la relatoria del Tribunal Superior del Distrito, el cual entre otras cosas nos pauto la búsqueda de descriptores y restrictores de cada sentencia.-

dc.descriptionThis work had its beginnings in the agreement between the Administrative Court of Santander, chaired by the Honorable Magistrate Doctor Solange Blanco Villamizar and the Research Center of the Autonomous University of Bucaramanga - Legal Studies - which is headed by its director the renowned lawyer and professor, teacher of the science of law, Doctor Laureano Gómez, both taking advantage of their knowledge and in order to improve the report module of the Administrative Court of Santander, took on the task of creating a research project which they called : "CASE LAW ANALYSIS OF THE PROVIDENCE ISSUED BY THE ADMINISTRATIVE COURT OF SANTANDER AND EXAMINED BY THE COUNCIL OF STATE, WITH THE PURPOSE OF IMPROVING THE SAME REPORT AND DEFINE ITS JURISPRUDENTIAL GUIDELINES", said project had the purpose of creating a jurisprudential line and providing through support from the academy that would help consolidate the rapporteurship of the aforementioned body ation. This is how initially, after selecting the study material by the corporation, the structural analysis of each of the sentences delivered was carried out, thus working on the identification of the sentence, selection of relevant facts, identification of the legal problem , fundamentals of the room, the sources used and the method (referring to the techniques of legal hermeneutics) used in each case; Once the intended result was obtained, a critical analysis of each of them was carried out, based on jurisprudential, legal and doctrinal criteria; Immediately afterwards, the previous result was synthesized in a table that was very kindly provided by the report of the Superior Court of the District, which, among other things, guided us to search for descriptors and restrictors of each sentence.-
