| Descripción : | El objetivo de la investigación es determinar si el Estado colombiano está obligado a garantizar el acceso a técnicas de reproducción asistida a través de su Sistema de Salud a personas diagnosticadas con infertilidad. Primero se intentará hacer un acercamiento a los Derechos Sexuales y Reproductivos como Derechos Humanos: Las TRA en casos de infertilidad, como una garantía del derecho a la salud, a la maternidad y a la paternidad. En segundo lugar, se presentarán pronunciamientos y normativa vigente en el Derecho Internacional y Derecho Comparado. The objective of the investigation is to determine if the Colombian State is obliged to guarantee access to assisted reproductive techniques through its Health System to people diagnosed with infertility. First, an attempt will be made to approach Sexual and Reproductive Rights as Human Rights: ART in cases of infertility, as a guarantee of the right to health, motherhood and fatherhood. Second, pronouncements and current regulations in International Law and Comparative Law will be presented. |
