Título :	Sobre a autonomia do direito do patrimônio cultural

Descripción :	O objetivo deste trabalho é demonstrar a autonomia do Direito do Patrimônio Cultural, principalmente, em relação ao Direito do ambiente. Para tanto, realizou-se um estudo comparado entre as ordens jurídicas brasileira e portuguesa, atentando-se, sobretudo, para o tratamento constitucional da matéria nos dois países. Constatou-se que, com efeito, a gênese e desenvolvimento histórico das normas que regulam a proteção e promoção do Patrimônio Cultural demonstram que há um anacronismo no enquadramento dessas normas do âmbito do Direito Ambiental. Mais importante, contudo, o fato de que o Direito do Patrimônio Cultural possui um objeto específico e distinto do objeto do Direito do Ambiente, consubstanciado na proteção da memória e identidade dos diferentes grupos e sociedades, que o afirma como ramo jurídico autônomo. Autonomia The autonomy of the cultural heritage law ABSTRACT: This paper aims at demonstrating the autonomy of the Cultural Heritage Law, mainly related to the Environment Law. In order to demonstrate it, there has been a compared study between the Portuguese and Brazilian legal commands, which focuses on the constitutional treatment of this topic in both countries. It has been confirmed that the origin and historical development of the rules that regulate the protection and promotion of the Cultural Heritage show an anachronism in the classification of these rules in the scope of the Environmental Law. However, the most important thing is the fact that the Cultural Heritage Law holds a specific and distinct object, consolidated in the protection of memory and identity of the different groups and societies, what makes it an autonomous legal branch.
