dc.description Flows of refugees and the reasons why people flee from their countries of origin, seeking protection in third countries, are different from the flows that occurred when the Convention on Refugee Status was approved. However, asylum law has not been changed, at least regarding the internationally legal and conceptual framework established in the 1951 Convention. Meanwhile, the current nature of migration has elicited government policies based on the logic of the control of migration flows. The inability to clearly distinguish between forced and voluntary migration, despite the willingness of states to do so, has caused this logic to affect the right of asylum to the detriment of the protection it implies.
