| dc.description | O movimento evolutivo dos direitos humanos e do constitucionalismo pode ser percebido de forma conectada, já que muito dos direitos fundamentais previstos internamente pelos Estados, resta, igualmente positivado pelos Tratados Internacionais em defesa dos direitos humanos. Assim, é importante perceber tanto um quanto o outro pelo viés cosmopolita. Ressalta-se, que não se pretende trazer a história do cosmopolitismo desde os cínicos até a contemporaneidade, mas demonstrar certas matizes do constitucionalismo cosmopolita kantiano que, ainda, hoje podem ser utilizadas pela sociedade internacional, com a finalidade de desenvolver Estados Democráticos voltados aos ideais humanitários, paradigma do Direito Internacional na atualidade. Destaca-se que com o auge da globalização econômica e a desconsideração de inegáveis valores morais, em prol do mercado, não é admissível apenas retornar ao ápice iluminista do século XVIII e XIX; entretanto, pode-se avançar, ou seja, desenvolver e aperfeiçoar o cosmopolitismo. A metáfora do espelho pretende realçar a imagem que fi ca, quando se coloca um movimento diante do outro visando o aperfeçoamento de ambos. Ademais, não se objetiva esgotar a matéria, mas sim, apresentar pontos de contato e distanciamento, bem como aspectos positivos e negativos relacionados a determinados entendimentos quanto á globalização, ao cosmopolitismo e ao próprio constitucionalismo. | es-ES |
| dc.description | The evolutive motion of the human rights and the constitutionalism may be seen as linked since several fundamental rights, which are internally provided by the States, are also positivised by International Treaties on human rights. Th us it is important to understand both via the cosmopolitan bias. We do not intend to bring up the history of cosmopolitanism from the beginning to contemporaneity, but to show some nuances of the Kantian cosmopolitan constitutionalism that may be used by the international society in order to develop democratic governments facing the humanitarian ideals, which are the paradigm of International Law. It is highlighted that with the rising of economic globalization and the disregard of undeniable moral values in favor of the market, it is not permissible to return to the Enlightenment apex of the eighteenth and nineteenth centuries; however, it is possible to develop and refi ne cosmopolitism. Th e metaphor of the mirror is mentioned to highlight the image formed when you put a motion before the other in order to enhance both. Furthermore, there is no intention in exhausting this issue, but provide points of contact and distance as well as positive and negative aspects related to certain conceptions concerning globalization, cosmopolitism and constitutionalism. | en-US |
