This article, developed through a bibliographical and documentary review, is part of theresearch “Mediation, human rights and citizenship: educational policies, conceptions and actionsin public schools of the state of São Paulo and Spain”, corresponding to the contextualization andtheoretical reflection of the role of teacher mediation in the education in human rights from agender perspective, specifically in Early Childhood Education. Thus, it brings the historicity andthe construction of the social category of gender as one of the agents of optimization and progressof the treatment applied to human diversity is brought forward, as support of the affirmationand compliments of the human rights of the subjects carried out by such category. It was held ahistorical rescue of the development of the gender category carried out over the years and thencontextualized with the promulgation of the Universal Declaration of Human Rights and Brazil’scommitment to the fulfillment of its guidelines and the human rights education, finally, to exposeand analyze the correspondences of the mediation proposal in public schools in the state of SãoPaulo with human rights education, as well as the gender implications in conflict management. Itshould be stressed that the social transformation contained in the category of gender and all thetheoretical-practical apparatus that this carries, studied and developed on scientific bases, reachesvalues and behaviors, reproduced culturally and historically, internalized in social relations and that,from these, gender proposes a change, the birth of a culture in/for human rights that respects andpraises the differences, in which mediation, and education as a whole, has a primordial function inthe formation of people in human values. Submissão: 2017-03-25 Aceite: 2017-08-10Este artigo, desenvolvido mediante revisão bibliográfica e documental, integra-se à pesquisa “Mediação, direitos humanos e cidadania: políticas educacionais, concepções e ações em escolas públicas estaduais paulistas e espanholas”, correspondendo à contextualização e reflexão teórica do papel da mediação docente na educação em direitos humanos na perspectiva de gênero, especificadamente, na Educação Infantil. Assim, traz-se a historicidade e a construção da categoria social gênero como um dos agentes de otimização e progresso do tratamento aplicado à diversidade humana, como sustentação da afirmação e cumprimentos dos direitos humanos dos sujeitos protagonizados por tal categoria. Realizou-se um resgate histórico do desenvolvimento da categoria de gênero ao longo dos anos para, em seguida, contextualizar com a promulgação da Declaração Universal dos Direitos Humanos e o compromisso do Brasil com o cumprimento de suas diretrizes e da educação em direitos humanos e, finalmente, expor e analisar as correspondências da proposta de mediação nas escolas públicas do estado de São Paulo com a educação em direitos humanos, bem como as implicações de gênero na gestão de conflitos. Ressalta-se que a transformação social contida na categoria de gênero e todo o aparato teórico-prático que este carrega, estudado e desenvolvido em bases científicas, atinge valores e comportamentos, reproduzidos cultural e historicamente, internalizados nas relações sociais e que, a partir destes, gênero propõe uma mudança, o nascimento de uma cultura em/para direitos humanos que respeite e preze as diferenças, na qual a mediação, e a educação como um todo, possui função primordial na formação de pessoas em valores humanos.
