| dc.description | The conformation of the laws that protect the cultural heritage in Cuba dates from the first decades of the twentieth century, during the period of the neocolonial Republic, from the implementation of decrees and restrictive laws to certain dimensions of the heritage with emphasis on the capital environment to the Inclusion in the 1940 Constitution of provisions regarding the protection of the nation's heritage, constituting a step forward in terms of its legal instrumentation, also reflecting the maturity of the sense of belonging and the efforts of activists and defense institutions of the Cuban cultural heritage. The manner in which the dispositions, decrees and laws of protection to the patrimony of the nation throughout the neocolonial Republic were instrumented, with successes and failures, constituted expression of the consolidation and reaffirmation of identity; the strengthening of an awareness about the meaning of the role of culture as a process of collective construction and as a mechanism for defending the historical legacy that progressively formed a set of experiences that the revolutionary government established in 1959 had to project policy cultural in general and the legislative body for the protection of the heritage of the nation in particular. | dc.description | La conformación de las leyes que protegen al patrimonio cultural en Cuba data de las primeras décadas del siglo XX transitando, durante el período de República neocolonial, desde la implementación de decretos y leyes restrictivos a determinadas dimensiones del patrimonio con énfasis en el entorno capitalino hasta la inclusión en la Constitución de 1940 de disposiciones referentes a la protección al patrimonio de la nación, constituyendo ello un paso de avance en lo que a su instrumentación jurídica se refiere, reflejando además la madurez del sentido de pertenencia y del esfuerzo de activistas e instituciones defensoras del acervo cultural cubano. La manera con que fueron instrumentadas las disposiciones, decretos y leyes de protección al patrimonio de la nación a lo largo de la República neocolonial, con aciertos y desaciertos, constituyó expresión de la consolidación y reafirmación identitaria; del fortalecimiento de una conciencia sobre el significado del papel de la cultura como proceso de construcción colectiva y como mecanismo de defensa del legado histórico que de manera progresiva fueron conformando un conjunto de experiencias con las que contó el gobierno revolucionario instaurado en 1959 para proyectar la política cultural en general y el cuerpo legislativo para la protección del patrimonio de la nación en particular.
