| dc.description | O presente artigo é fruto de uma pesquisa interdisciplinar intitulada “Estudo das Implicações Psíquicas e Jurídicas nas Relações de Filiação Decorrentes da Adoção: a Interferência da Identidade Sexual dos Adotantes nas Decisões Judiciais”, que buscou verificar em que medida a sexualidade dos adotantes poderá intervir na sentença do magistrado, bem como de que forma o saber psicanalítico poderá contribuir para o entendimento aprofundado da diversidade sexual com vistas à proteção da dignidade da pessoa humana. O estudo da sexualidade torna-se imperativo para o tema da adoção devido ao novo conceito de família retratado na Constituição da República Federativa do Brasil de 1988 e para a proteção constitucional sobre os direitos fundamentais, especialmente o da dignidade humana e da igualdade. ABSTRACT The Interference of the Sexual Indentity of Adopters in Judicial Decisions The present paper is the product of an interdisciplinary research entitled “Study of Psychic and Juridical Implications in the Relationships of Affiliation Resulting From Adoption: the Interference of the Adopter’s Sexual Identity on Judicial Decisions”, which aimed for verifying how the adopter’s sexuality might interfere at the judge’s sentence, as well as in which way the psychoanalytical knowledge may contribute for a deep comprehension concerning the sexual diversity in order to accomplish the protection of human dignity. The study of sexuality becomes imperative in the subject of adoption due to the new concept of family depicted at the Brazilian Federative Republic Constitution of 1988 and to the constitutional protection over fundamental rights, specially the human dignity and equality. | pt-BR |
