| dc.description | O presente artigo trata da mais recente mudança de entendimento dos Tribunais Superiores brasileiros em relação à (im)possibilidade da prisão civil do depositário infiel e do devedor fiduciário, além de fazer uma introdução sobre o conflito de fontes no direito brasileiro. O STF, em dezembro de 2008, proferiu decisão afirmando o caráter supralegal dos tratados internacionais que versem sobre direitos humanos, ratificados pelo Brasil, incluindo-se nesse rol o Pacto de São José da Costa Rica. Dessa forma, entendeu-se que a hipótese de prisão civil se aplica somente ao devedor de alimentos, já que o referido tratado teria revogado toda a legislação ordinária anterior sobre a matéria.THE TREATIES IN BRAZIL: THE CIVIL IMPRISONMENTS IN CASES OF FIDUCIARY DEBTOR AND DEPOSITSThis essay is about the recent change of the brazilian Superior Courts understanding concerning the civil imprisonment in the cases of failure of trustee depositary and fiduciary debtor and, furthermore, to do an introduction about the conflict of sources in brazilian law. The Federal Supreme Court, on December 2008, passed judgement stating the supralegal character of the international treaties when they are related to the question of the human rights, ratified by the government of Brazil, and is included in this list the San Jose de Costa Rica Pact. This way, it is understood that the hypothesis of civil imprisonment is only to be applied in the cases of alimony debtor, once this treaty would have revoked all the previous ordinary legislation about this matter. | pt-BR |
