This article analyses the merging of the Ministry of the Interior with the Ministry of Law and Justice which began in 2002 (as part of the Public Administration Renovation Programme - PRAP) and continued up to 2010, involving open discussion about the need for splitting them up. The article indicates the conditions affecting the country and the legal sector at the time, as well as those affecting each ministry during these years. It deals particularly with such merger and the results seen in terms of how the merged ministry should address itself to resolving problems. Experience has shown that this was effectively a case of failed reform in which fiscal arguments predominated from the start, technical analysis having been left aside but which would have shown that such merger was "artificial" and was condemned (sooner or later) to become questioned. The new ministry did not gel; it could rather be said that there were two ministries having the same name. There was no consolidation or institutionalisation within the public setting, especially regarding a topic as sensitive as justice, and thus the need for reform leading to re-creating the Ministry of Justice began to be expressed before the end of the president Uribe´s second term in office.El artículo presenta el análisis de la experiencia de la fusión del Ministerio del Interior con el Ministerio de Justicia y del Derecho acaecida en el año 2002 (bajo el Programa de Renovación de la Administración Pública PRAP) y desarrollada hasta el año 2010, en el que comienzan a plantearse las discusiones en la opinión pública acerca de la necesidad de escindirlos. En este recorrido se señalan tanto las condiciones del país y del sector justicia como de cada uno de los ministerios a lo largo de esos años, centrándose, especialmente, tanto en el proceso de fusión como en los resultados vistos en términos de la solución de los problemas que debía abocar el ministerio fusionado. Lo que la experiencia muestra es que efectivamente se trata de un caso de reforma fallida donde, desde el comienzo, predominaron argumentos de tipo fiscal, dejando por fuera análisis técnicos que permitían señalar, como se verá, que la fusión era “artificial” y que estaba condenada, tarde o temprano, a ser cuestionada. El nuevo ministerio no “cuajó”, más bien había dos ministerios bajo el mismo nombre, no logró consolidarse ni institucionalizarse en el ámbito público, especialmente en un tema tan sensible como es el de la justicia, y por ello, ya desde antes de finalizar el segundo periodo de gobierno del Presidente Uribe, se comenzó a ventilar la necesidad de la reforma que permitiera re-crear el ministerio de Justicia
