The legal-binding effects of prior consultation on environmental projects

dc.description	Prior Consultation has become, in recent years, a mechanism through which communities can exercise their right to participate in projects, actions, or legislative measures that may directly affect them. However, its implementation in the Colombian context presents various challenges due to issues such as the lack of clarity regarding prior consultation and its outcomes, stemming from limited legal treatment of the subject. Through a documentary review of the concept of prior consultation, the legal nature of prior consultation and the agreement and disagreement resulting from it, this research analyzed the legally binding effects arising from actions resulting from prior consultations with ethnic communities regarding administrative acts directly impacting the environment. Thus, it is concluded that the fundamental right character of prior consultation makes the failure to comply with the prior consultation procedure and the resulting agreement a direct violation of the right that can be protected through a legal remedy, leading to the nullification or suspension of the activity causing harm. On the other hand, the administrative act of environmental licensing arising from the disagreement in prior consultation is subject to administrative jurisdiction, and its non-compliance is resolved through this avenue.	en-US
dc.description	La Consulta Previa, se ha constituido en los últimos años como un mecanismo mediante el cual las comunidades pueden ejercer el derecho a la participación sobre los proyectos, actos o medidas legislativas que los puedan afectar directamente; sin embargo, su aplicación en el contexto colombiano presenta diversas problemáticas, esto debido a inconvenientes como la falta de claridad la consulta previa y sus productos producto del poco tratamiento legal sobre el tema. Por medio de una revisión documental del concepto de consulta previa, la naturaleza jurídica de la consulta previa y del acuerdo y el desacuerdo producto de esta, esta investigación analizó los efectos jurídicos-vinculantes derivados de los actos producto de las consultas previas en comunidades étnicas sobre actos administrativos que afectan directamente el medio ambiente; de esta forma se concluye que el carácter de derecho fundamental hace que el incumplimiento del procedimiento de consulta precia y el acuerdo que resulta de esta es una violación directa del derecho que se puede proteger vía tutela produciendo así la nulidad o suspensión de la actividad que causa el perjuicio; pero por el lado del acto administrativo de licencia ambiental que nace del desacuerdo en la consulta previa se sujeta a la jurisdicción contenciosa administrativa y su incumplimiento se resuelve por esta vía.	es-ES
