dc.description	This research exposes the theoretical foundations to incorporate gender perspective in the following essay exposes the theoretical foundations to incorporate gender perspective in the judicial process. It argues that gender analysis is a key tool to impart justice from the perspective of international and constitutional legal standards on Human Rights. It is important for the lives of women and their families. This issue is addressed from the perspective of the science of law with support of doctrinal, jurisprudential and legislative sources on human rights. The essay concludes by proposing some basic criteria in order to use gender perspective in the justice administration. In Comparative Law, good practices of applying Justice with a gender perspective are fulfilled, mostly from the jurisprudence of the Inter-American System. These suggestions, which must be taken into account in order to guarantee the due process of women’s rights towards an egalitarian society in which law and justice serve as instruments of peace for the construction of a culture of legality and protection of human rights.	en-US
dc.description	La presente investigación expone los fundamentos teóricos para incorporar la perspectiva de género en los procesos judiciales en el Salvador. Se sostiene que el análisis de género, en cuanto herramienta para impartir justicia a la luz de estándares jurídicos internacionales y constitucionales sobre los derechos humanos, es relevante en la vida de las mujeres y sus familias. Se aborda esta problemática desde la ciencia del derecho, apoyándose en fuentes doctrinales, jurisprudenciales y legislativas en materia de derechos humanos. El estudio propone algunos criterios básicos para la implementación del enfoque de género en la administración de justicia. En Derecho Comparado se observan buenas prácticas de aplicación de la Justicia con perspectiva de género, principalmente desde la jurisprudencia del Sistema Interamericano. Dichas sugerencias deben ser retomadas para garantizar el debido proceso de los derechos de las mujeres hacia una sociedad igualitaria en donde el derecho y la justicia sirvan como instrumentos de paz para la construcción de una cultura de legalidad y de protección de los derechos de los seres humanos.	es-ES
