The subject of this article is to show an overview of a problem that occurred in the Peruvian Electricity Sector in 2004 and, unfortunately, still produces practical and legal effects in the current system. We refer to the “physical withdrawals of capacity and energy from the SEIN for the attention of the regulated market”, by the different distribution companies without having a PPA signed and valid with any generating power company.El objeto del presente artículo consiste en mostrarle al lector un panorama general sobre un problema que ocurrió en el sector eléctrico peruano en el 2004 y que lamentablemente aún produce efectos prácticos y jurídicos en el ordenamiento vigente, pues no ha podido ser resuelto y solucionado de manera integral y definitiva. Nos referimos a los retiros físicos de potencia y energía del SEIN, destinados a la atención del mercado regulado, por parte de las distintas empresas distribuidoras, sin que tengan un contrato de suministro (PPA) firmado y vigente con alguna empresa generadora.
