| dc.description | In 1994, Rwanda underwent a terrible genocide between the Hutu and the Tutsi ethnic groups. The Rwandan Patriotic Front stopped the killings. The new government of the RPF built the Gacaca Courts as a justice and truth mechanism, its goal was to prevent the impunity of the genocide suspects and to promote reconciliation among Rwandans. The present article makes a contribution to the analysis of this case in order to establish how the experience of the Gacaca Courts can teach us something about the reconciliation process and for the current implementation of the Peace Agreements between the FARC-EP and the Colombian Government. The analysis focus on justice and reconciliation as the principal elements of the Gacaca Courts in order to build a parallelism between their postulates and experiences in implementing international legal standards of human rights, and the legitimacy of the mechanism of the Special Peace Jurisdiction in Colombia. | en-US |
| dc.description | En 1994 Ruanda vivió un terrible genocidio entre las etnias Hutu y Tutsi al que la victoria militar del Frente Patriótico Ruandés le puso fin. El gobierno del FPR implementó los Tribunales Gacaca como un mecanismo de justicia y verdad, que tuvo como objetivo principal impedir la impunidad de los responsables de los delitos cometidos durante el genocidio para promover la reconciliación entre los ruandeses. El presente artículo analiza los alcances de los Tribunales Gacaca que contribuyeron al proceso de reconciliación de la población ruandesa y los aprendizajes que de ello se deriva para Colombia en la implementación de los Acuerdos de Paz con las FARC-EP. El análisis se centra en la justicia y en la reconciliación como elementos principales de los Tribunales Gacaca, realizando un paralelo de sus postulados y experiencias en la práctica, basado en la legitimidad del mecanismo y el cumplimiento de los estándares internacionales en derechos humanos, con el acuerdo de la Jurisdicción Especial para la Paz en Colombia. | es-ES |
