dc.description	This article attempts to analyze the contested discourses related to the design of transitional justice mechanisms in the context of the peace process between the Colombian Government and the FARC during the period 2012-2016. The starting point of this work is based on a critical sociolegal perspective that goes beyond the institutional frameworks that have prevailed in the international literature on Transitional Justice. The article highlights the relevance of studying social and political contexts, and processes related to the discursive constructions on peace or victims’ rights protection. In this regard, the article provides an account of the political and legal disputes related to the design of the Agreement on Victims of the Armed Conflict. In summary, the Agreement is the outcome of the endeavor to balance maximalist approaches —retributivism— regarding victims’ rights, with minimalist perspectives —amnesties—, such as the FARC’s reluctance to accept punishment.	en-US
dc.description	Este artículo analiza los discursos y actores que entran en tensión en la configuración de los mecanismos de justicia transicional en el contexto del proceso de paz entre el Gobierno nacional y las Fuerzas Armadas Revolucionarias de Colombia (FARC) en el periodo 2012-2016. El punto de partida de esta reflexión se basa en una perspectiva sociojurídica crítica que va más allá de las orientaciones institucionalistas que han predominado en la literatura internacional sobre justicia transicional. El artículo hace mayor énfasis en la necesidad de estudiar los contextos y los procesos sociales y políticos que dan lugar a las construcciones discursivas sobre la paz o la defensa de los derechos de las víctimas; en tal sentido, da cuenta de las disputas políticas y jurídicas que se han presentado con ocasión del Acuerdo sobre las Víctimas del Conflicto. En conclusión, el Acuerdo es el resultado de un esfuerzo por balancear posturas maximalistas —retributivas— en materia de derechos de las víctimas y posturas minimalistas —amnistías—, como la renuencia de las FARC a aceptar penas privativas de la libertad.	es-ES
