dc.description | From conservative or progressive sides, it cannot be denied that in recent decades the judicial system of the Latin American constitutional courts have favored certain social movements.This does not prevent, to dismiss, the dangers that this activism entails. Tension between state reason and legal reason. Ambivalence caused by the activity to characterize the court as a negative legislator or positive legislator. Concern for individual guarantees or for the democratic political process. The imminent legislative function and even the constituent role assumed. dc.description | Desde orillas conservadoras o progresistas, no se puede negar que en las últimas décadas el activismo judicial de los tribunales latinoamericanos en sede constitucional, ha favorecido ciertos movimientos sociales. Esto no obsta para desestimar los peligros que conlleva este activismo, tensión entre razón de Estado y razón jurídica, ambivalencia que provoca la actividad para caracterizar al tribunal como legislador negativo o legislador positivo, preocupación por las garantías individuales o por el proceso político democrático, la inminente función legislativa e incluso constituyente que debe asumir. A continuación esbozaremos consideraciones históricas para sustentar por qué existe un activismo judicial de corte “publicista” cuando se trata de abordar temáticas relacionadas con movimientos sociales, en el seno de los tribunales constitucionales latinoamericanos, para seguidamente apuntalar en algunos fallos de estos países, y terminar con otros de Colombia. | es-ES |
