Por su parte el sistema procesal acusatorio, que rompe con un sistema violatorio de los derechos del procesado y aún con la garantía en juicio de los derechos de los acusados establecidos en la Constitución Política, no garantizaba plenamente la participación de la defensa en la fase de investigación llevada a efecto por la Policía Nacional y orientada por el Ministerio Público, para una futura acusación, a pesar de encontrarse establecido en nuestra jurisprudencia, que los actos de investigación son parte material del proceso penal aún cuando éste formalmente no exista todavía, pues si bien el Ministerio Público y la Policía Nacional no son órganos jurisdiccionales, realizan una actividad típicamente procesal con el fin de dar sustento a la actividad requirente que se plantea frente al órgano jurisdiccional, a ello debe agregarse que estos órganos en su actividad de persecución penal podrían afectar derechos fundamentales de las personas. La nueva audiencia especial de tutela de garantías constitucionales permite al juez de garantías el autorizar o convalidar actos de investigación en la fase de investigación complementaria solicitada por el Ministerio Público, y así minimizar o incluso eliminar el abuso o la arbitrariedad.
