| dc.description | This article explores the ways of naming people deprived of their liberty that the State uses through legal and normative discourse. The act of being named offers the possibility of social existence. Language has an agency, a power to hurt, it produces effects. Therefore being called by a hurtful name degrades, belittles. Discriminatory discourse, for its part, is characterized by the construction of an adequate cognitive nucleus to justify the rejection, the denial of the "other". A distinction is made between "us" the honest and "they" the lawbreakers. It is noted in laws, decrees and codes that the State, through legal and normative discourse, enunciates a language of hatred and a discriminatory discourse that confiscates the exclusion of individuals deprived of their liberty, through offensive and disqualifying ways of being appointed. It causes linguistic damage, by questioning them from a position of subordination that is reproduced in institutions such as jail or judicial offices. | en-US |
| dc.description | Este artículo explora los modos de nombrar a las personas privadas de su libertad que emplea el Estado a través del discurso jurídico y normativo. El acto de ser nombrado ofrece la posibilidad de existencia social. El lenguaje posee una agencia, un poder de herir, produce efectos. Por lo tanto, ser llamado por un nombre hiriente degrada, menosprecia. El discurso discriminatorio, por su parte, se caracteriza por la construcción de un núcleo cognitivo adecuado para justificar el rechazo, la negación del "otro". Se plantea una distinción entre “nosotros” los honrados y “ellos” los infractores de la ley. Se advierte en leyes, decretos y códigos que el Estado a través del discurso jurídico y normativo enuncia un lenguaje del odio y un discurso discriminatorio que confisca a la exclusión a los sujetos privados de su libertad, mediante formas ofensivas y descalificantes de ser nombrados. Provoca un daño lingüístico, al interpelarlos desde una posición de subordinación que es reproducida en las instituciones como la cárcel o en las dependencias judiciales. | es-ES |
