This article analyses the possible legal solutions for digitalisation of protected works deposited in documentary and cultural heritage institutions. The main difficulty in achieving this objective is the requirement that protected works cannot be used - before they enter the public domain - without the agreement between the owners of the rights of those works and the users. Two main ways to access the works are studied. The first is agreements between owners and cultural institutions, where some applied schemes and experiences are explored, the most promising being the path of collective agreements, which seems to safeguard the interests of holders through a system of guarantees. The other way is the application of exceptions and limits in application of European Union legislation, several exceptions are studied, such as the one referring to orphan works and out-of-commerce-works and the on-site consultation. This way of exceptions and limits of rights is insufficient due to the complexity to regulate access to the works, as well as insecurity and high management costs to obtain the consent of the owners. There is also a need to adopt some of the legal solutions that avoid legal gaps and generate a safe environment for cultural, scientific and intellectual exploitation
Este estudio analiza las posibles soluciones legales, para la puesta en línea de obras protegidas, depositadas en las instituciones documentales y de patrimonio cultural. La principal dificultad para alcanzar este objetivo es la exigencia de que las obras protegidas, no pueden ser usadas --antes de su entrada en el dominio público-- sin el acuerdo entre los titulares de los derechos de esas obras y los usuarios. Se analizan dos vías principales para acceder a las obras. La primera son los acuerdos entre titulares y las instituciones culturales, en donde se exploran algunos esquemas aplicados y las experiencias llevadas a cabo, siendo la más prometedora la vía de acuerdos colectivos, que parece salvaguardar los intereses de los titulares mediante un sistema de garantías. La otra vía es la aplicación de las excepciones y límites en aplicación de la legislación de la Unión Europea, se estudian varias excepciones, tales como la referida a las obras huérfanas y a obras que están fuera del circuito comercial y a la consulta in situ. Esta vía de excepciones y límites de derechos se observa insuficiente debido a la complejidad para regular el acceso a las obras, así como la inseguridad y los altos costes de gestión para obtener el consentimiento de los titulares. También se observa la necesidad de adoptar alguna de las soluciones jurídicas, que eviten lagunas legales y generen un entorno seguro de explotación cultural, científica e intelectual.
