dc.description	This article attempts to present a critique of ethical and legal implications underlying at the moment of declaring an unconstitutional state of affairs against the problem of overcrowding in prisons by the Colombian Constitutional Court, highlighting not only the massive violation of fundamental rights, but also the indifference with which operate citizens in Colombia, relegating to a minority of the population becomes vulnerable to the residual treatment of society and a State that refuses to solve that problem, citing a budget deficit and an inability of its institutions to face them; attacking on many fronts the work done by the Court in this important decision.	en-US
dc.description	Este artículo intenta poner de presente una crítica de implicaciones ético-jurídicas que subyacen al momento de decretar un estado de cosas inconstitucional frente al problema del hacinamiento en las cárceles por parte de la Corte Constitucional colombiana, resaltando no sólo la vulneración masiva de derechos fundamentales, sino también la indiferencia con la que operan los ciudadanos en Colombia, relegando a una minoría de la población que se vuelve vulnerable ante ese trato residual de la sociedad y de un Estado que se niega a resolver ese problema, aduciendo un déficit presupuestal y la una incapacidad de sus instituciones para hacerle frente; atacando desde varios frentes la labor hecha por la Corte en esta trascendental sentencia.	es-ES
dc.description	Este artigo procura apresentar uma crítica às implicações ético-jurídicas subjacentes ao momento de declarar inconstitucionalidade do problema da superlotação das prisões pelo Tribunal Constitucional colombiano, ressaltando não só a violação em massa dos direitos fundamentais, mas também a indiferença com que os cidadãos operam na Colômbia, relegando uma minoria da população que se torna vulnerável a esse tratamento residual da sociedade e de um Estado que se recusa a resolver este problema, citando um déficit orçamentário e a incapacidade de suas instituições para enfrentá-lo; atacando de várias frentes o trabalho realizado pelo Tribunal nesta sentença transcendental.	pt-BR
