| dc.description | Este artículo pretende aportar al entendimiento de la relación entre el procedimiento judicial y el proceso mediante jurado en Estados Unidos. Para ello, se analizar el origen tanto del procedimiento judicial como del juicio ante jurado en el siglo XII en el las década previas a la promulgación de la Carta Magna. Finalmente, se concluye con un análisis acerca la implementación del derecho a un juicio a través de jurado y se argumenta que esto no se debe Carta Magna per sé, sino al Cuarto Concilio de Letrán. | es-ES |
| dc.description | This article seeks to contribute to the understanding of the relationship between the judicial and the trial by jury in the United States. For this, it is analyzed the origin of both the legal proceedings and the trial by jury in the twelfth century, decades previous to the promulgation of the Magna Carta. Finally, it is concluded with an analysis about the implementation of the right to trial by jury and it is argued that this should not Magna Carta per se, but to the Fourth Lateran Council. | en-US |
