| dc.description | This article aims to brief analysis of legal, social and psychological mechanisms of police approach, especially the grounds of suspicion in its legal and socio-psychological. Looking at the dominant culture in police tried to understand its origin, how it influences and is influenced by the field of subjectivity and what relation to the violation of custody rights and guarantees individual and collective. From this it is imperative that we saw the paradigm shift in public safety policy, especially from the qualification and enhancement of its effective direct operators as well as effective monitoring of their activity, by state and society, through legislation more refined and correctional agencies independent, resulting in a more efficient control over the discretion given to them and unrestricted compliance with the principle of legality and your real applicability. | en-US |
| dc.description | Este artigo tem como objetivo a breve análise dos aspectos jurídicos, sociais e psíquicos dos mecanismos de abordagem policial, sobretudo, a fundamentação da suspeição em seus aspectos jurídicos e sócio-psíquicos. Analisando a cultura dominante na polícia procuramos compreender a sua origem, como a mesma influencia e é influenciada pelo campo da subjetividade e, qual relação guarda com a violação de direitos e garantias individuais e coletivos. A partir disso, vimos que é imperiosa a mudança de paradigma na política de segurança pública, sobretudo a partir da qualificação e valorização efetiva de seus operadores diretos, bem como o monitoramento efetivo de sua atividade, pelo Estado e pela Sociedade, através de uma legislação mais aprimorada e de órgãos correcionais independentes, resultando em um controle mais eficiente sobre o poder discricionário a eles conferido e a observância irrestrita do princípio da legalidade e sua aplicabilidade real. | pt-BR |
