| dc.description | Throughout the history of Brazilian education legislation, early childhood education was being legitimized as formal education space and contemplated in the legal instruments such as the child's right. In this article we consider the construction of the notion of the right to education, seeking to understand how historically man began to refer to the concept of human right and how this impacted on the concept of the right to education and the right to early childhood education in Brazil. | dc.description | Ao longo da história da legislação educacional brasileira, a educação infantil foi sendo legitimada como espaço de educação formal e contemplada nos instrumentos legais como direito da criança. Neste artigo iremos contemplar a construção da noção de direito à educação escolar, buscando entender como historicamente o homem começou a se remeter ao conceito de direito do homem e como este impactou no conceito de direito à educação escolar e direito à educação infantil no Brasil.
