La teoría comunicacional del derecho sostiene que todo ordenamiento jurídico representa una perspectiva textual para entender y valorar el conjunto del mundo jurídico. El carácter perspectivista del ordenamiento no sólo implica que desde él se “ve” la realidad exterior en escorzo, a través del texto ordina-a golpe de decisión. Hay que distinguir, por tanto, entre perspectivismo externo y perspectivismo interno. El sistema hace explícita la perspectiva ordinamental. El mundo jurídico es plural. Frente al monismo, caracte-rístico de la teoría del derecho natural y asimismo de la Escuela vienesa, que conciben el derecho como un de ordenamientos, cada uno de los cuales constituye una perspectiva para enjuiciar los actos humanos. De ahí la necesidad de subrayar el principio de relatividad en el derecho.
Communication theory of law holds that any legal system is a textual perspective to unders-tand and evaluate all of the legal world. The perspectival character of the system not only implies that since he “sees” the external reality foreshortened through ordinamental text. It also means that the system “sees” himself and “decides” to develop as a shock decision perspective. We must distinguish therefore between perspectivism perspectivism internal and external. The system makes explicit the ordinamental perspective. The legal world is plural. Against the monism, characteristic of natural law theory and also of the Viennese School, who conceive of law as a unitary order that unfolds in several times, communication theory states the thesis of the plurality of systems, each of which provides a perspective for judging human actions. Hence the need to emphasize the relativity principle in law.
