| dc.description | En este artículo se pretende desarrollar los principios generales del derecho, en primer lugar, haciendo alusión a ellos de manera general, desde diferentes conceptos tratados por la Jurisprudencia y la doctrina; y, en segundo lugar, abordando específi-camente los enunciados de la Constitución Política y del ordenamiento jurídico colom-biano. Los principios generales se desarrollan en el artículo como criterios que enmarcan al operador jurídico dentro de unos parámetros formales en el ejercicio de la actividad judicial. Es necesario precisar que dentro de las funciones que tienen estos principios se encuentran la creadora, la integrativa y la interpretativa; esto es, le sirven al juez como criterios auxiliares al momento de aplicar el derecho en un caso concreto. A su vez estos establecen los límites políticos y jurídicos de la colectividad —derechos subje-tivos y objetivos colectivos—, integrando el carácter político que se desprende de ellos. Por otro lado, el artículo desarrolla la parte axiológica consagrada en el preámbulo de la Constitución Política colombiana, con el fin de mostrar estos valores como los principios fundamentales que permean todo el ordenamiento jurídico y constitucional. | dc.description | This article seeks to develop the general principles of law, first of all by referring to them in a general way, from different concepts dealt with by jurisprudence and doctrine; and, secondly, by addressing specifically the provisions of the Constitution and the Colombian legal system. The general principles are developed in the article as criteria that frame the legal operator within formal parameters in the exercise of the judicial acti-vity. It should be pointed out that the functions of these principles include the creator, the integrative and the interpretative; that is, they serve as auxiliary criteria for the judge when applying the law in a specific case. These, in turn, establish the political and legal limits of the collectivity, which are subjective rights and collective objectives, integrating the political character that derives from them. On the other hand, the article develops the axiological part enshrined in the preamble to the Colombian Constitution, in order to show these values as the fundamental principles that permeate the entire legal and constitutional order. The main analysis of this article is derived from Judgment C-284 of 2015, which is relevant to the development that the Constitutional Court has given to the principles. | |
