| dc.description | La Constitución de Colombia define la familia como la conformada entre un hombre y una mujer. Esta concepción resulta sumamente excluyente cuando se constata diversidad de individuos y tipologías de familia que no se ven reflejadas ni en la Constitución ni en la legislación Colombiana. Analizando el caso específico de la tipología de familia homosexual, si bien es cierto que en Colombia se han hecho avances desde la misma despenalización de la homosexualidad desde 1935 y los reconocimientos subsiguientes y contempo-ráneos en lo respectivo a los derechos de tipo patrimonial, no existe, sin embargo, una igualdad integral para estas parejas a pesar de lo demandado. La Corte Constitucional ha demostrado un activismo y garantismo sin precedentes en esta materia. El artículo expone estos avances, así como el debate jurídico actual en torno al matrimonio igualitario y cómo se percibe el reconocimiento de esta tipología de familia en la comunidad estudiantil universitaria IUE, y finalmente, su posición frente a una posible reforma constitucional. | |
| dc.description | The Colombian Constitution defines the family as one formed by a man and a woman. This concept of family is highly exclusive when it is evident the existence of a diversity of individuals and family types that are not expressed neither in the Constitution nor in the legal framework. Taking into consideration the homosexual family type, there has been important progress since the decriminalization of the homosexuality in 1935 and the subsequent accomplishments, especially in terms of hereditary rights. However, there is not an integral and homogenous acknowledgement of gay ́s couples rights. The Constitutional Court has been proac-tive and it has demonstrated an important level of interest in the matter as this paper shows, as well as the legal debate around gay marriage, the perception of this family type in the IUE students, and finally, the proposal of a Constitutional Amendment to solve this issue. | |
