“Quem nuptiae demonstrant…” Some thoughts on filiation and lesbian motherhoods from an anthropological perspective

dc.description	Considering the evolution of the treatment of filiation in cases of women in same-sex marriages, this article relativizes the idea of the increasing weight of biological arguments. While in the determination of the filiation there is a persisting focus on giving birth as evidence of the mother-child relationship, we can also observe how different interpretations and decisions regarding the spouse’s maternity status are leaning toward giving greater relevance to factors such as the spouse’s will to be a mother, the couple’s parenthood project, and by extension marriage as an institution into which that project is subsumed. The article shows the emergence of matrimonial filiation as a third type of filiation that is based neither on biology nor on adoption. Although it is not expressly regulated by law, this different type of filiation is being effectively applied to establish filiation in cases of donor-conceived children born in lesbian sex-same marriages.	en-US
dc.description	Tomando como caso la evolución del tratamiento de la filiación en mujeres en matrimonio homosexual, el artículo relativiza la idea de la cada vez mayor importancia de los argumentos biológicos en la determinación de la filiación. En estos casos se constata, por una parte, la persistencia del parto como evidencia de la relación materno filial. Por otra se observa que las diferentes interpretaciones y resoluciones en torno a la maternidad de la cónyuge optan por dar protagonismo a la voluntad de ser madre, al proyecto parental y al matrimonio como institución que subsume este proyecto. El artículo muestra la emergencia de un tercer tipo de filiación, la filiación matrimonial, que está siendo aplicada en los casos de matrimonios de mujeres por donante. Se trata de un modo de filiación diferente a la natural o a la adopción, que está siendo efectivamente aplicada pero que, sin embargo, no está recogida expresamente en la normativa.	es-ES
