| dc.description | On November 27, 2007, the Law of Minimal Budgets for Environmental Protection of Native Forests was sanctioned with the purpose of stopping the increasing leveling of forests and ensuring the conservation of surviving forests. This law is important when analyzing the relationship between the National Power and the Provinces because it allows demonstrating the manner in which the provinces respond to the constitutional mandate to sanction the complementary laws in the environmental area, as well as the impact that these laws exert on environmental conservation. This paper seeks to determine the scopes of Native Forest Law enforcement in the Argentinean provinces. Thus, an exploratory study has been conducted considering two indicators: first, the adequacy of the Provinces Laws regarding the standards of the National Law; and second, the illegal deforestation rate per province. Based on the study of these indicators and starting from the literature on federalism, decentralization, and public policies, it is argued that enforcement of the Native Forest Law is not homogeneous in the national territory, but in theoretical terms, enforcement responds to four possible scenarios: “effective enforcement”; “effective implementation”; “simulation games”; “subnational autonomy, and “race to the bottom”. | en-US |
| dc.description | El 27 de noviembre de 2007 fue sancionada la Ley de Presupuestos Mínimos de Protección Ambiental de los Bosques Nativos con el propósito de detener los desmontes crecientes y de garantizar la conservación de los bosques sobrevivientes. Esta ley resulta particularmente importante para analizar el juego de relaciones entre nación y provincias, porque permite observar tanto el modo en que las provincias responden al mandato constitucional de sancionar leyes complementarias en el área ambiental, como el impacto que estas leyes tienen en la conservación del ambiente. Este trabajo busca determinar cuáles son los alcances de la implementación de la Ley de Bosques en las provincias argentinas. Para ello, se realiza un estudio exploratorio teniendo en cuenta dos indicadores: la adecuación de las normativas provinciales a los criterios y estándares dispuestos en la ley nacional y la tasa de deforestación ilegal por provincia. Con base en estos indicadores, y partiendo de la literatura sobre federalismo, descentralización y políticas públicas, se sostiene que la implementación de la Ley de Bosques no es homogénea en todo el territorio nacional, sino que, en términos teóricos, responde a cuatro escenarios posibles: “implementación efectiva”, “juego de simulación”, “autonomía subnacional” y “carrera hacia abajo”. | es-ES |
