The following article reviews, with historical and comparative legal methods, central and illustrative facts of the two centuries of the great transformation towards a material constitutional state, examining one of the counter-waves more pronounced in this general trend, the European antiliberal and fascist interbellum in the example of Nazi Germany (1933- 1945). The text wants to analyze the role of judges of this moment, critically reviewing the famous hypothesis of Radbruch according to which legal positivism had blinded the German legal establishment against the enormous injustices of the dictatorship. In nine subchapters, first, it develops the research problem and methodological approach. Then, there are some considerations about the historical origins of the confrontation between positivism and natural law. The third subchapter asks for the deconstruction of democratic constitutions of Weimar (1930-1933) and Vienna (1933- 1938). Fourth, the author examines the elements of a pseudo-legal positivism in the Nazi era from 1933. The fifth chapter analyzes the positive laws of the regulatory state in the exceptional state. Sixth, the author discuses the elements of the nature law ideology that the Nazi state developed. Following he presents some considerations about the almost-complete “desjuridificación” in the war years (1939-1945). Furthermore, the eighth subchapter examines the transitional justice and the long shadow of impunity after 1949, concluding in the ninth subchapter with 15 lessons on the history of the Nazi judges
El siguiente artículo revisa, con métodos histórico-jurídicos y comparados, hechos centrales e ilustrativos de los dos siglos de la gran transformación hacia el Estado constitucional material, examinando una de las contracorrientes más acentuadas en dicha tendencia general: la Europa antiliberal y fascista del Interbellum,en el ejemplo de la Alemania nazi (1933-1945). Se quiere analizarel papel de los jueces de entonces, revisando críticamente la famosa hipótesis de positivismo de Radbruch según la cual el positivismo jurídico hubiera convertido en indefenso al estamento judicial alemán frente a las enormes injusticias de la dictadura.En nueve subcapítulos se desarrolla, primero, el problema de investigación y acercamiento metodológico. Siguen algunas consideraciones sobre los orígenes históricos del enfrentamientopositivista-iusnaturalista. El tercer subcapítulo pregunta por ladeconstrucción de las constituciones democráticas de Weimar (1930-1933) y Viena (1933-1938). En cuarto lugar, se analizan los elementos de un seudopositivismo jurídico en la época nazi a partir de 1933. El quinto subcapítulo estudia las leyes positivas del Estadonormativo dentro del Estado excepcional. En sexto lugar, se desarrollan los elementos del iusnaturalismo ideológico del Estado nacionalsocialista. En seguida, se reflexiona sobre la desjuridificación –casi– completa en los años de guerra (1939-1945). De modo complementario, el octavo subcapítulo examina la justicia transicional y la larga sombra de impunidad después de 1949, para concluir en el noveno con 15 lecciones sobre la historia de los jueces nazi.
