| dc.description | In a context in which human rights, understood as one of the central themes of modern democracies, seems to have important, and perhaps sufficient, progress in terms of the normative acquis foreseen for its protection and enforceability from a legal perspective, the present document shifts its focus to the challenges that its guarantee represents to the political system, called to manage human rights policies, projects and programs. An obligation that, although it is one of the pillars and purposes of the State, at least in Colombia, is not an obvious task due to the particular characteristics of the matter to be managed. This article seeks to demonstrate that, although human rights are the indispensable compensation mechanism of functionally differentiated societies, they also satisfy characteristics of a wicked problem for the administration that seeks to realize them through its programs. For this purpose, based on the general theory of social systems, the first section outlines the role of human rights in contemporary societies. The next section limits the distinctive features of the concept of wicked problems proper to the analysis of public policies. Finally, from the review of Human Rights Action Plans for 17 countries, the article characterizes human rights from the concept of wicked problem. | en-US |
| dc.description | En un contexto en el que los derechos humanos, entendidos como uno de los temas centrales de las democracias modernas, sugiere tener importantes y, tal vez, suficientes avances en cuanto al acervo normativo previsto para su protección y exigibilidad desde la perspectiva jurídica, el presente documento traslada su centro de atención hacia los desafíos que su garantía representa para el sistema político que está llamado a gestionar políticas, proyectos y programas en derechos humanos. Una obligación que, si bien se constituye en uno de los pilares y finalidades del Estado, al menos el colombiano, no por eso resulta una tarea evidente por las características particulares del asunto por ser gestionado, en este caso, los derechos humanos (DD.HH.). En este orden de ideas, el presente artículo busca demostrar que, aunque los DD.HH. son el mecanismo indispensable de compensación de las sociedades funcionalmente diferenciadas, también podrían satisfacer características de un wicked problem para la administración que procura realizarlos a través de sus programas. Con este propósito, en un primer aparte, con base en la teoría general de los sistemas sociales, se esboza la función de los DD.HH. en las sociedades contemporáneas. A continuación, se delimitan los rasgos distintivos del concepto de los wicked problems propio del análisis de las políticas públicas. Finalmente, a partir de la revisión de los Planes de Acción en Derechos Humanos de 17 países, se pretende caracterizar los DD.HH. a la luz del contenido del concepto de wicked problem. | es-ES |
