The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization is the international legal framework, which applies the third objective of the Convention on Biological Diversity. The main purpose is to guarantee transparent, agile and equal access. The article includes a summary of the international negotiations which lasted almost 10 years, and an analysis of the main elements of the Protocol. For Latin American and Caribbean countries the implementation of the Nagoya Protocol presents various challenges. This article addresses four of them: two are strictly legal in nature, one of which is general (the development of national regimes) and the other applicable to marine genetic resources; the third relates to unauthorized activities and biopiracy; the fourth focuses on promoting scientific research.El Protocolo de Nagoya sobre Acceso a los Recursos Genéticos y Participación Justa y Equitativa en los Beneficios que se Deriven de su Utilización es el instrumento internacional que desarrolla el tercer objetivo del Convenio sobre la Diversidad Biológica con la finalidad de que el acceso sea transparente, ágil y en términos equitativos. En el artículo se resume el proceso, que duró casi una década, que tomaron las negociaciones internacionales y se analizan los principales elementos del Protocolo. Para los países de América Latina y el Caribe la implementación del Protocolo de Nagoya representa varios retos; este artículo aborda cuatro de ellos: dos estrictamente legales, uno de nivel general (el desarrollo de regímenes nacionales), un segundo aplicable al régimen marino, un tercer reto de carácter preventivo de actividades no autorizadas y biopiratería, y el último relativo al fomento de la investigación científica.
