Descripción :	Dentro del campo de estudio de la teoría constitucional, el presente artículo tiene por finalidad abordar la idea y concepto de Constitución, desde la filosofía del derecho y la filosofía política. A tales efectos, el trabajo se encuentra dividido en tres partes principales. La primera parte establecelas bases teóricas sobre las cuales se edificó la idea y concepto de Constitución en el mundo antiguo (Atenas y Roma). La segunda parte analiza la idea y concepto de Constitución desde la perspectiva del constitucionalismo, mostrando su innegable vínculo con las tesis liberales clásicas, y su thelos, a saber: la protección de la libertad individual frente al poder político. La tercera parte presenta una refutación a las argucias teóricas que han pretendido vaciar de contenido la idea y concepto de Constitución, del constitucionalismo, con el fin de propugnar una idea y concepto de “Constitución”, puro y equivalente a cualquier forma de Estado, incluso, de aquellos en donde no se garantiza la libertad, a través de las garantías de la separación de poderes, propiedad privada y la garantía de los derechos.An Introduction to Idea and Concept of Constitution (From Ancient Times to Modern Constitutionalism)AbstractThe purpose of this paper is to approach the concept and the idea of Constitution from the perspective of philosophy of law and political philosophy. To such effect, this article has been divided into three main parts. In the first part, I lay the theoretical basis on which the idea and concept of Constitution were built in the ancient world (Athens and Rome). In the second part, I analyze the idea of Constitution from the perspective of constitutionalism, showing its undeniable link with the classic liberal thesis, and its aim, that is: the protection of individual liberty in front of political power. In the third part, I contest the theoretical arguments that have attempted to void the core idea and concept of constitutionalism with a view to encouraging an idea and concept of “Constitution”, pure and equivalent to any form of State, even those States where liberties are not guaranteed by the principle of separation of powers, the protection of private property and guarantees to rights.
