| Descripción : | Con la creación del Consulado de Comercio de Cartagena en 1795 surgió en el Virreinato de la Nueva Granada una institución con funciones de promoción del comercio y con capacidad para administrar justicia. Esta nueva institución tuvo un gran impacto en el desarrollo de la vida económica y judicial del Virreinato de la Nueva Granada a finales del siglo XVIII y principios del siglo XIX. Esta investigación profundiza en el desarrollo de la función de administración de justicia concedida al Consulado de Comercio de Cartagena, describiendo sus principales funciones y analizando diversos conflictos de jurisdicción con otras instituciones contemporáneas que también tenían asignadas funciones judiciales. Así mismo, el documento estudia la forma como la distancia geográfica que separaba las provincias del interior del Virreinato y Cartagena, así como la distancia social entre el Consulado y los comerciantes sujetos a su jurisdicción, influyeron en la administración de justicia mercantil. Este análisis permite observar el rol que la administración de justicia mercantil tuvo dentro del marco general del pluralismo jurídico que caracterizaba el sistema de justicia del imperio español. De la misma forma, la investigación resalta el rol que los agentes del proceso judicial, como tribunales y comerciantes, asignaban a la distancia (geográfica y social) a la hora de evaluar el modelo más adecuado para la administración de justicia mercantil. With the creation of the Consulate of Commerce of Cartagena in 1795, an institution with functions of trade promotion and capacity to administer justice emerged in the Viceroyalty of New Granada. This new institution had a great impact on the development of the economic and judicial life of the Viceroyalty of New Granada at the end of the 18th century and the beginning of the 19th century. This investigation delves into the development of the function of administration of justice granted to the Consulate of Commerce of Cartagena, describing its main functions and analyzing various jurisdictional conflicts with other contemporary institutions, which also had assigned judicial functions. Likewise, the document studies how the geographical distance that separated the provinces of the interior of the Viceroyalty and the city of Cartagena, as well as the social distance between the Consulate and the merchants subject to its jurisdiction, influenced the administration of mercantile justice. This analysis allows us to observe the role that the commercial justice administration had within the general framework of the legal pluralism that characterized the justice system of the Spanish empire. In the same way, the investigation highlights the role that the agents of the judicial process, such as courts and merchants, assigned to distance (geographical and social) when evaluating the most appropriate model for the administration of commercial justice.
