Descripción :	Se plantea la presente investigación, la cual persigue determinar los posibles escenarios de responsabilidad estatal por la actividad médica asistencial en las intervenciones quirúrgicas con finalidades estéticas cuando el acto médico ha sido la causa eficiente del daño antijurídico sufrido por el paciente. Para ello, se parte de un diseño exploratorio del fenómeno para estudiarlo al interior de la jurisprudencia nacional en el análisis de contenido de las sentencias; todo lo cual junto con la triangulación de fuentes, permitirá formular criterios hermenéuticos para la estructuración de la responsabilidad médico estatal en el presente caso. Se plantea como objetivo general, establecer la responsabilidad patrimonial del Estado por la actividad médico asistencial en las cirugías estéticas a partir del estudio i) del título de imputación que se predica de la actividad médico asistencial, y ii) del comportamiento de la jurisprudencia del Consejo de Estado respecto al título de imputación como elemento determinante la responsabilidad del estado frente a los daños causados en la actividad medico asistencial, y para formular criterios interpretativos para la estructuración de la responsabilidad médica estatal en las cirugías estéticas. Se parte de la hipótesis según la cual, se configura la responsabilidad patrimonial del Estado por los daños antijurídicos causales a una paciente en un procedimiento estético cuando la falla en el servicio médico asistencial es la causa eficiente del daño, y por tanto del fracaso de las intervenciones quirúrgicas. Pregrado The present investigation is proposed, which seeks to determine the possible scenarios of state responsibility for medical assistance activity in surgical interventions for aesthetic purposes when the medical act has been the efficient cause of the unlawful damage suffered by the patient. To do this, we start from an exploratory design of the phenomenon to study it within national jurisprudence in the content analysis of sentences; all of which, together with the triangulation of sources, will make it possible to formulate hermeneutical criteria for the structuring of state medical responsibility in the present case. The general objective is to establish the patrimonial responsibility of the State for the medical assistance activity in aesthetic surgeries based on the study i) of the title of imputation that is predicated of the medical assistance activity, and ii) of the behavior of the jurisprudence of the Council of State regarding the title of imputation as a determining element the responsibility of the state against the damages caused in the medical assistance activity, and to formulate interpretive criteria for the structuring of the state medical responsibility in aesthetic surgeries. It is based on the hypothesis according to which, the patrimonial responsibility of the State is configured for the unlawful causal damages to a patient in an aesthetic procedure when the failure in the medical assistance service is the efficient cause of the damage, and therefore the failure of the surgical interventions.
