Título :	The Custody of Prisoners Held in Civil Police Precincts and the Reflections of this Practice on Public Security A Custódia de Presos Realizada em Delegacias de Polícia Civil e os Reflexos dessa Prática na Segurança Pública

Descripción :	This study aimed to address the problem involving the custody of prisoners held in civil police stations, by civil servants belonging to the staff of the judicial police career dependencies. The aim was to analyze if misuse of public office occurs when these Public Safety professionals engage the mentioned task, as well as checking what are the practical implications resulting from such custody, from the perspective of human rights of these prisoners, especially regarding the highest principle of human dignity, observing whether mentioned rights are violated. The study has also sought to demonstrate how the subject is focused by the Constitution Federal/1988, by infra brazilian legislation and international human rights treaties to which Brazil is a signatory, talking in general terms, on some important points relating to the topic , as the institutional functions of the judicial police, violence, crime and prison system. Finally, delineates what are the effects of this practice on public safety. Este trabalho teve por objetivo abordar a problemática que envolve a custódia de presos realizada nas dependências de delegacias de polícia civil, por servidores públicos pertencentes ao quadro de carreira da polícia judiciária. O intuito foi analisar se ocorre desvio de função pública quando esses profissionais da Segurança Pública se ocupam da aludida tarefa, assim como verificar quais são as implicações advindas da prática de tal custódia, sob a perspectiva dos direitos humanos desses encarcerados, sobretudo no que tange ao princípio maior da dignidade da pessoa humana, observando se mencionados direitos estão sendo violados. O estudo buscou demonstrar ainda, como o assunto é enfocado pela Constituição Federal/1988, pela legislação infraconstitucional brasileira em vigor e pelos tratados internacionais de direitos humanos de que o Brasil é signatário, discorrendo em linhas gerais, sobre alguns pontos relevantes respeitantes ao tema, como as funções institucionais da polícia judiciária, a violência, a criminalidade e o sistema prisional. Por fim, procurou delinear quais são os reflexos dessa prática, na segurança pública.
