Título :	Estado social de derecho, políticas de desarrollo rural y territorialidad en Colombia

Descripción :	Partiendo de la base de las tres condiciones que un Estado de derecho debe cumplir: eficacia, legitimidad y legalidad, esta ponencia hace un análisis de las políticas de de-sarrollo rural y la territorialidad en Colombia con relación al Estado Social de Derecho (ESD). Se encontraron evidencias de que existen regiones del territorio nacional en las cuales la presencia del Estado está en disputa. La disputa por el control territorial es ma-yor en las zonas de frontera, donde a su vez se evidencia el uso ilegítimo de la violencia por otros actores diferentes al Estado, lo cual ha contribuido al conflicto armado que vive la Nación desde hace años. En un contexto como el colombiano, donde el Estado, para favorecer los intereses económicos de empresas multinacionales viola la dignidad y los derechos humanos de las poblaciones, vía paramilitarismo, precarización laboral, favorecimiento del sistema bancario, entre otras acciones, el Estado no puede proteger o garantizar ni la dignidad ni los derechos humanos, pues, regula en función de los inversionistas y sus inversiones. Se observa la necesidad de recuperar la aplicación del ESD de manera efectiva en todas las zonas del territorio. Se sustenta que para garantizar la dignidad humana y el respeto por los derechos humanos, se requiere que el pueblo colombiano tenga una mayor participación en los territorios y por tanto en el poder que le ha otorgado el Estado sobre esto On the basis of the three conditions that a state of law must meet: effectiveness, legi-timacy and legality, this paper makes an analysis of rural development policies and the territoriality in Colombia with respect to the Social State of Law (ESD). Were found evi-dence that there are regions of the national territory in which the presence of the State is in dispute. The dispute over territorial control is greater in the border areas, where to turn is evidenced by the illegitimate use of violence by other different actors the State, which has contributed to the armed conflict that lives the nation since years ago. In a context such as the Colombian, where the State, in order to favor the economic interests of multinational corporations violates the dignity and human rights of the populations, paramilitarism, job insecurity, promotion of the banking system, among other actions, the State cannot pro-tect or guarantee neither dignity nor human rights, because it regulates based on investors and their investments. It notes the need to retrieve the application of the ESD effectively in all areas of the territory. It is sustained that to ensure human dignity and respect for human rights, it is required that the Colombian people have a greater involvement in the territories and therefore in the power given to him to the State on thes
