| Descripción : | Product of centuries of well-founded criticism, understandable censorship and mere diatribes, the law has been blurred to the point of reducing it to a plain normativist technique of servile oppression to any kind of power, censorship from which it has been promoting the idea that it is a moral duty to disobey the law. Faced with this tendency I try to approach the law as it is, emphasizing that like any human product, despite having serious defects and deficiencies, the law has unequivocal virtues and strengths that nourish the incessant fight for the monopoly to define and control its content and functioning. Producto de siglos de fundadas críticas, comprensibles censuras y meras diatribas, el derecho ha sido desdibujado hasta el punto de reducirlo a una llana técnica normativista de opresión servil a cualquier clase de poder, censura a partir de la cual se viene promocionando la idea de que es un deber moral desobedecer el derecho. Ante esta tendencia, intento aproximarme al derecho tal y como es, enfatizando que, como todo producto humano, pese a tener serios defectos y carencias, el derecho posee inequívocas virtudes y fortalezas que nutren la incesante lucha por el monopolio de definir y controlar su contenido y funcionamiento. |
